MONITORING — search for violations within a project

Monitoring — one search for possible violations of intellectual rights of one right holder in online sources within the created project.

Trademark monitoring:
The search is conducted without limiting the number of trademarks belonging to one right holder, as well as the number of product and service names related to these trademarks.

Copyright object monitoring:
The search is conducted without limiting the number of copyright objects belonging to one right holder.

Based on the monitoring results, the user receives:

• found materials and links to sources;
• available data on infringement sources;
• detailed reports;
• visual dashboards;
• the ability to select violations and initiate their elimination from the personal account.

ELIMINATION OF ONE VIOLATION — claim work within the project

Elimination of one violation — a complete set of turnkey out-of-court actions aimed at stopping one violation identified within the project:

1. Determination of the contact details of the infringer and the information intermediary (hosting provider, marketplace, social network, messenger, etc.).

2. Built-in action algorithm taking into account the jurisdiction of the infringer and the information intermediary.

3. Automatic generation and sequential sending of appeals and claims in accordance with the type of violation and applicable legislation:

— notifications,
— requests for supporting documents,
— demands,
— pre-trial claims.

4. Automated interaction with the infringer and the information intermediary after receiving the appeals.

5. Automatic check of violation elimination.

Elimination is launched separately for each selected violation and is paid according to the selected tariff.

What is considered one violation
For the purpose of forming a ticket and tarification, one violation is considered a set of related materials identified within one placement source.

One violation may include:

• all cards of one seller on one marketplace;
• all pages and links with violations within one website or domain;
• all publications of one account or community in a social network;
• all materials of one channel in a messenger or on a video hosting service;
• all related materials within another single placement source.

PROJECT — the main entity of LexUP

Project is a comprehensive work to protect the intellectual property of one right holder, formed by one type of intellectual property object and combining monitoring and claim work on identified violations.

Within the project:

• monitoring is configured and carried out;
• the claim work block is configured;
• potential violations are identified;
• the user selects violations for suppression;
• a full cycle of claim work is launched for the selected violations;
• documents, action history, and work results are saved;
• results, reports, and dashboards are generated.

A project can be formed:

• by trademarks - for monitoring and protecting the trademarks of one right holder;
• by copyright objects - for monitoring and protecting the copyright objects of one right holder.

Trademarks and copyright objects are not combined in one project.
